Kendrapara: Despite the ordinance passed by the Union Cabinet making triple talaq as a punishable offence, the practice seems to have continued in Kendrapara district as a woman lodged complaint with police alleging that her husband applied the age old practice to divorce her instantly.
The victim of Mirjapatana under Derabish block in the district had married one Sallauddin Khan some years ago. After a few days of marriage, he and his family members had started torturing her demanding more dowries, she alleged.
“I was beaten up several times by the in-laws members. My baby was also tortured. They all inflicted mental torture on me. My husband asked to bring more dowries, which I was unable to give them. Recently, he had tried to divorce me by uttering talaq three times (triple talaq) as per the Islamic tradition,” she said.
The Family members of the accused, however, rubbished the allegation and stated that it was not a triple talaq. “As far as we know that he had gave her single talaq which doesn’t constitute an instant divorce. We are trying to make compromise between them,” Salaluddin’s uncle (paternal) said.
Notably, the Supreme Court had last year annulled the triple talaq system and deemed it as unconstitutional. A five-judge bench of the apex court had found the practice un-Islamic and “arbitrary”, and disagreed that triple talaq was an integral part of religious practice.
After the Supreme Court verdict, the Union Cabinet cleared the ordinance in September which makes instant triple talaq, a criminal offence that will attract a maximum jail term of three years. President Ram Nath Kovind had given his assent on the day of Cabinet approval.
